Talking Title IX and College Sports with Dr. Ellen Staurowsky

I joined Dr. Ellen J. Staurowsky of my alma mater Ithaca College on her podcast Talking Title IX and College Sports. Our conversation revolved around a federal court case being brought in in California by college athletes seeking NIL and broadcasting compensation against the NCAA and the Power Five Conferences. At the time of recording, the case was at the class certification stage and featured fascinating Title IX arguments brought by both sides.

Sidebar with Judge Dan Winslow

I joined Judge Dan Winslow on his show Sidebar to discuss all things sports law. Some topics included the draft as an antitrust violation, the current legal landscape of collegiate sports, Lamar Jackson self-negotiating his NFL contract, and more. You can view clips from the podcast below and check out the full episode here: LINK

An explanation as to why the draft meets the basic requirements for an antitrust violation. This is step one of the analysis, however, and courts have found the draft qualifies for the nonstatutory labor exemption and has been upheld. I touch on the famous case featuring a former Ohio State Buckeye challenging the draft in the full episode. See Clarett v. NFL, 369 F.3d 124 (2d Cir. 2004).

Lamar Jackson is attempting to self-negotiate a $200 million contract with the Baltimore Ravens. The value of having an agent has recently been called into question. Dan and I discuss some of the potential shortcomings of self-negotiating and why Lamar participating at the bargaining table could lead to a difficult future with the Ravens.
